# Beliv Studios Inc. — Terms and Conditions

For the website www.belivstudios.ca, the Beliv Studios online store, client galleries, and all photography, videography and livestreaming services provided in Ontario, Canada.

Effective: October 9, 2026. Last updated: October 9, 2026. Version 1.0.

Please read these Terms carefully before using this website, booking a service, or placing an order. By accessing www.belivstudios.ca, browsing a client gallery, or purchasing from the Beliv Studios store, you agree to be bound by these Terms. If you do not agree, do not use the Website or Services.

## 1. About Beliv Studios Inc. and These Terms

Beliv Studios Inc. is an Ontario-based creative business providing professional photography, videography, livestreaming, and related creative products through this Website and in person in Hamilton, the Greater Toronto Area (GTA), and, by arrangement, elsewhere in Ontario and Canada.

These Terms and Conditions ("Terms") form a binding agreement between you ("you", "customer", "client") and Beliv Studios Inc. ("Beliv Studios", "we", "us", "our"). They apply to: (a) browsing the Website and any portfolio, blog, or informational pages; (b) viewing or downloading from client galleries; (c) booking or receiving photography, videography or livestreaming services; and (d) purchasing products from the online store, including physical goods, printed products, and digital downloads.

Additional written agreements for a specific event or project (for example, a wedding or corporate booking contract, model release, or licence) supplement these Terms. If there is a conflict, the signed project agreement governs for that project. The English version of these Terms controls.

## 2. Who You Are Contracting With — Ontario Disclosure

In accordance with the disclosure requirements for internet agreements under Ontario's Consumer Protection Act, 2002, we disclose the following before you enter into an online transaction with us. Please save or print a copy of these Terms for your records.

Legal name: Beliv Studios Inc., also operating as Beliv Studios (belivstudios.ca).

Website: www.belivstudios.ca. Contact: info@belivstudio.com and through the contact and booking forms on the Website.

Currency: All prices on the Canadian store are in Canadian dollars (CAD) unless expressly stated otherwise.

Taxes: Harmonized Sales Tax (HST) applies where required by law and is shown or included as indicated at checkout. See Section 8.

Payment processor: Stripe. We do not store full card numbers on our servers.

Delivery: Physical goods are shipped within Canada or, where offered, delivered locally in Hamilton/GTA or available for local pickup, as selected at checkout. Digital goods and galleries are delivered electronically. See Sections 6 and 10.

If any disclosure above is incomplete at the time you order, your rights under the Consumer Protection Act, 2002 are not diminished. Contact us through the Website if you need clarification before ordering.

## 3. Eligibility and Account Use

- You must be at least 18 years old, or the age of majority in Ontario, to place an order or book services, or you must have the consent of a parent or legal guardian who agrees to these Terms on your behalf.

- If you receive gallery access credentials or a password for a client gallery, you are responsible for keeping those credentials confidential and for all activity under them. Notify us immediately of any unauthorized use.

- You agree to provide accurate, current and complete information when ordering or booking, and to update it promptly. We may decline, cancel or limit orders or bookings where information is inaccurate, payment cannot be processed, or these Terms are breached.

- Gallery and account access is personal to the client named. Sharing login credentials publicly, selling access, or allowing unauthorized third parties to download content is prohibited (see Sections 5 and 6).

## 4. Our Services and Online Store

### 4.1 Creative Services

Beliv Studios provides photography, videography, livestreaming and related creative services for weddings, events, portraits, corporate and community projects, as described on the Website. Descriptions, portfolios and sample galleries show the style and quality of our work, but every event and deliverable is unique. Portfolios are not a guarantee of identical results for your event.

### 4.2 Online Store

The online store on belivstudios.ca offers, when listed, categories including "Gifts and Greetings" (for example, paintings, customized cards, picture frames and photography-related items) and "Christian Greetings" (customized Christian-themed cards with Bible verses or quotations, including seasonal bundles and church notice templates). Product availability, descriptions and images are as listed at the time of order. We make reasonable efforts to display colours and images accurately, but screen settings may cause variations. Minor variations do not constitute a defect.

### 4.3 Print-on-Demand and Third-Party Fulfilment

Some products may be produced or fulfilled by third-party print-on-demand or printing partners after you order. For those items, production times are in addition to shipping times, and slight variations inherent in on-demand printing may occur. Section 16 applies to third-party providers.

### 4.4 Changes to Services and Listings

We may update, discontinue or change services, products, prices and Website content at any time without prior notice, but changes will not affect orders or signed bookings already accepted, except as required by law or agreed in writing.

## 5. Copyright and Intellectual Property — No Use Without Permission

In brief: Everything on this Website is protected by copyright and belongs to Beliv Studios Inc. or its licensors or clients. Do not copy, download (except where we expressly enable it for you), screenshot for commercial use, repost, sell, edit or use any photo, video, design, text or branding without our prior written permission.

### 5.1 Ownership

All content on the Website and in client galleries — including photographs, videos, livestream recordings, graphics, paintings and artwork, card designs, templates, text, logos, the "Beliv Studios" name and branding, website design, layout, and underlying code — is owned by Beliv Studios Inc., its creator, or its clients or licensors, and is protected by the Copyright Act (Canada), trademark and other intellectual property laws. © 2026 Beliv Studios Inc. All rights reserved.

### 5.2 No Permission Implied

Access to the Website or to a gallery (including a public portfolio or demo gallery) does not give you any ownership, licence or permission to use the content beyond viewing it for personal, non-commercial purposes in your browser. No content may be taken, copied or reused from this Website without our prior written permission.

Without prior written authorization from Beliv Studios Inc., you must not: copy, download, save, screenshot, screen-record, reproduce, republish, upload, post, transmit, distribute, sell, rent, sublicense, or publicly display any photograph, video, design, template, text or other material from the Website or galleries; modify, edit, filter, crop out watermarks, create derivative works from, or use any content for commercial purposes, advertising, social-media business pages, resale, print products, or AI or machine-learning training, dataset creation or style replication; remove, obscure or alter any copyright notice, watermark, credit, or digital rights information (including EXIF or metadata); frame, mirror, scrape or systematically harvest the Website or its content, or use robots or spiders for bulk downloading, except for ordinary search-engine indexing; or claim Beliv Studios' work as your own or imply endorsement by Beliv Studios or any person depicted.

### 5.3 Limited Personal Licence (When Granted)

Where we expressly provide a download button or written licence for specific files, we grant the named client a limited, non-exclusive, non-transferable, revocable licence to download and use those files only for the personal purposes (or, if stated in writing, defined commercial purposes) set out in your booking agreement, and only in accordance with any print or release terms provided. Unless a commercial licence is expressly stated in writing, client downloads are for personal use and personal printing only. Any commercial, editorial, advertising or resale use requires a separate written licence and fee.

### 5.4 Respect for People Depicted

Photographs and videos may depict identifiable individuals and private events. Even where you have obtained a file lawfully, you must respect the privacy and image rights of people depicted, and must not use images of others in a defamatory, misleading, or unlawful manner, or without any consent required for your intended use (for example, commercial use of a person's likeness).

### 5.5 Trademarks

"Beliv Studios", the Beliv Studios logo, and related branding are trademarks (registered or unregistered) of Beliv Studios Inc. No licence to use them is granted. Other names and logos on the Website belong to their respective owners.

### 5.6 How to Request Permission or a Licence

To request permission to use any content, contact us in writing at info@belivstudio.com with: the exact image, design or video (link or file name), the intended use, where and how long it will appear, whether it is commercial, and the size or audience. Permission, if granted, will be in writing and may be subject to a licence fee and credit requirement (for example, "Photo © Beliv Studios Inc. — Used with permission"). Oral permission is not sufficient.

### 5.7 Copyright Infringement and Takedown

We respect creators' rights and expect others to do the same. If we discover unauthorized use, we may require immediate removal, disable gallery or account access, pursue payment of a reasonable licence fee, and exercise remedies under the Copyright Act (Canada), including statutory damages, injunctions and takedown notices to hosts, platforms and internet service providers. If you believe content on the Website infringes your copyright, contact us at info@belivstudio.com with identification of the work, the URL, your contact details, and a good-faith statement. We will review and act expeditiously as required by Canadian law.

### 5.8 User Submissions

If you send us testimonials, reviews, ideas, images for printing or customization, or other materials, you retain ownership of content you own, but you grant Beliv Studios a non-exclusive, royalty-free licence to use, reproduce and display the submitted material as reasonably necessary to provide the product or service you ordered (for example, printing your chosen photo or text on a card or frame). You confirm that you own or have all necessary rights and consents to provide the material, and that it does not infringe any third party's rights. We may decline or remove submissions that are unlawful, infringing or offensive.

## 6. Client Galleries, Proofs and Demo Galleries

### 6.1 How Galleries Work

Clients may receive access to a private online gallery (for example, through a "Client Login" link, unique password, or private link) to view proofs and, where activated, download final files. Galleries are provided for the named client and their invited family or guests only. You must not post private gallery links or passwords publicly.

### 6.2 View-Only and Demo Galleries

A demo or sample gallery (including test galleries featuring consenting past clients, such as wedding samples) is provided for viewing the style and presentation of our work only. Where a gallery is marked "Demo" or "View Only", the following applies even if a download button is visible: downloading, copying, screenshotting for reuse, printing, or sharing files beyond viewing in the browser is disabled and prohibited. Clicking a download button may display a notice that the gallery is a demo account; no licence is granted in demo or sample images, even if the depicted clients have consented to the gallery being shown publicly as a portfolio sample; and we may withdraw or unpublish a demo or portfolio gallery, or remove any image, at any time — for example, if a depicted person withdraws consent (see Section 13.3).

### 6.3 When Downloads Are Activated

Downloads are activated individually per client, normally after full payment for the applicable package, as stated in your booking agreement. Upon activation, Section 5.3 applies. Download availability, file formats, resolution, and the gallery hosting period will be as described in your booking. It is your responsibility to download and safely back up your files during the hosting period. After the hosting period expires, we may archive or delete gallery files. Retrieval from archives, if possible, may incur a fee and cannot be guaranteed.

### 6.4 Proofing and Selection

Proof images may be unedited, watermarked, or lower resolution, and are for selection purposes only. They must not be published, printed or edited. Final deliverables will be edited in Beliv Studios' professional style. Requests for specific re-edits beyond the included scope may incur additional fees, quoted in advance.

### 6.5 No Circumvention

You must not attempt to circumvent view-only settings, watermarks, password protection, download limits or other technical measures, or use tools to bulk-download or scrape a gallery. Doing so is a breach of these Terms and may infringe copyright.

## 7. Bookings for Photography, Videography and Livestreaming

### 7.1 Enquiries and Booking Confirmation

Submitting an enquiry or "Book Now" request does not reserve a date. A booking is confirmed only when: (a) we confirm availability in writing (email is sufficient), (b) the booking details (date, time, location, services, package, price) are recorded, and (c) any required booking fee or deposit is received, and/or a written booking agreement is signed, as we advise for your event. Wedding and event dates are allocated on a first-confirmed basis.

### 7.2 Booking Fees, Deposits and Payment Schedule

A booking fee or deposit may be required to reserve your date. The amount and payment schedule will be stated in your booking confirmation or agreement. The booking fee compensates us for reserving the date and declining other work. Whether any portion is refundable on cancellation is governed by Section 11 and your booking agreement, subject to Ontario consumer law. Balance payments must be received by the due date stated. We may pause editing, gallery delivery or livestream preparation if payment is overdue.

### 7.3 Event Details, Access and Client Cooperation

You are responsible for providing accurate event details, schedules, venue rules (including photography or filming restrictions, and livestream connectivity requirements), permits, and a contact person on the day. You must obtain any venue, religious-institution or third-party permissions required for photography, videography, livestreaming and, where applicable, music or broadcast. Poor connectivity, venue restrictions, weather, or failures of third-party platforms may affect livestream or recording quality. See Sections 17 and 18.

### 7.4 Livestreaming Specifics

Where livestreaming is booked, we will use reasonable efforts to stream at the agreed start time and platform. Livestreams depend on internet connectivity, platform availability (for example, YouTube, Facebook, Zoom, or private links) and power at the venue. We are not responsible for platform outages, automated copyright or mute actions by platforms (for example, for copyrighted music), or viewers' devices or connections. A recording of the livestream, if included in your package, will be delivered as described in your booking.

### 7.5 Creative Direction, Coverage and Limitations

Beliv Studios will exercise professional judgment regarding locations, poses, coverage, editing style, and which images or clips are delivered. We will make reasonable efforts to capture requested shots, but cannot guarantee that every requested image, moment, guest, or specific scene will be captured, due to the live and unpredictable nature of events. You should provide a list of "must-have" shots well in advance. We will try, but capture is not guaranteed.

### 7.6 Rescheduling and Postponement

If you need to reschedule, notify us in writing as soon as possible. We will make reasonable efforts to accommodate a new date, subject to availability. Any transfer of a booking fee to a new date, and the time window for doing so, will be as stated in your booking agreement. If we cannot accommodate the new date, Section 11 applies.

### 7.7 Our Right to Decline or Withdraw

We may decline a booking or stop coverage if the environment becomes unsafe, unlawful, or abusive, or if required consents or permissions are absent. In such a case, amounts paid for services not provided will be handled in accordance with your booking agreement and applicable law, subject to Section 18.

## 8. Prices, Currency, Taxes and Payment by Stripe

### 8.1 Prices and Currency

All store prices are shown in Canadian dollars (CAD). Service and package prices are in CAD unless your booking agreement states otherwise. Prices exclude taxes and, for physical goods, shipping or delivery charges, unless expressly stated as included. Errors in pricing may be corrected. If we discover an error in a price for an item you ordered, we will contact you and you may cancel without penalty before the item is shipped or produced.

### 8.2 Harmonized Sales Tax (HST) — Ontario

Beliv Studios Inc. is based in Ontario. Where required by the Excise Tax Act (Canada), HST at the prevailing Ontario rate will be charged on taxable supplies. At checkout or on your invoice, HST will be shown separately or included as indicated. Tax rates and rules change. The rate applied will be the legally required rate at the time of supply. For orders shipped outside Ontario or Canada (if ever offered), taxes, duties and import charges may differ and are the customer's responsibility.

### 8.3 Payment Methods — Stripe Only

We accept payment online through Stripe, including major credit cards, debit cards where supported, Apple Pay and Google Pay, as displayed at checkout. We do not accept PayPal for the online store unless expressly stated otherwise on the Website at the time of payment. For services booked offline, we may accept e-transfer, card via Stripe, or other methods confirmed in writing. We do not store full payment-card numbers. Payment processing is handled by Stripe under its own terms and privacy policy (see Section 16).

### 8.4 Payment Authorization and Security

By providing payment information, you confirm that you are authorized to use the payment method, and authorize Stripe and us to charge the total amount (including taxes and shipping). Payments may be subject to verification and fraud checks by Stripe or your issuer. If payment is reversed, dishonoured, or charged back, you remain liable for the amount owed and reasonable costs incurred, and gallery access, downloads or shipments may be suspended until payment is resolved.

### 8.5 Deposits and Pre-Authorization

Where a deposit or booking fee is charged online, the amount, purpose and refund terms will be disclosed before you pay. For print-on-demand or customized products, payment may be taken at the time of order because production begins shortly after ordering (see Sections 10 and 11).

## 9. Orders, Confirmation and Electronic Contracts

### 9.1 How an Order Is Formed

Your order is an offer to buy. An order is accepted — and a contract is formed — only when we send an order-confirmation email or otherwise confirm acceptance in writing, or when we ship or provide the product, whichever is earlier. We may decline or cancel an order before acceptance (for example, out of stock, suspected fraud, pricing error, or inability to produce a custom item), in which case any payment taken will be refunded promptly.

### 9.2 Order Confirmation and Record Retention

After an accepted internet order, we will send a confirmation to the email address you provided containing: the items or services ordered, total price including HST and shipping, currency, delivery method and estimated timing, and our contact information, together with a copy or link to these Terms as accepted. In accordance with Ontario's Consumer Protection Act, you will be given an opportunity to review, correct and confirm your order before it is finalized, and to retain or print the confirmation. Please keep your confirmation and invoice for your records.

### 9.3 Express Opportunity to Accept or Decline

At checkout, you will be required to actively indicate acceptance of these Terms (for example, by ticking an unchecked box stating "I agree to the Terms and Conditions" with a link to this page) before payment is completed. Your acceptance will be recorded with the date and time of the transaction.

### 9.4 Electronic Communications

You consent to receive communications, agreements, invoices and receipts electronically. Electronic records and acceptances are binding to the extent permitted by Ontario's Electronic Commerce Act, 2000. You are responsible for providing a valid email address and for checking spam filters.

### 9.5 Customized and Personalized Orders

For customized products (for example, cards with your text or photos, framed prints, seasonal bundles made to order), please proofread all names, dates, Bible verses or quotations, photos and shipping details carefully before submitting. We may send a proof for approval where stated. Your approval confirms the design and text as correct. Errors that were present in the material you approved may require a paid reprint. See Section 11.

## 10. Shipping, Local Delivery (Hamilton/GTA) and Pickup

### 10.1 Shipping Areas and Processing

We currently ship physical products within Canada to the address provided at checkout, using the shipping method or zone selected. We do not ship to addresses we cannot verify, or to jurisdictions where delivery is not offered at checkout. Processing time is in addition to transit time. Print-on-demand and customized items require production time before shipping, as indicated on the product page or at checkout.

### 10.2 Shipping Charges, Tracking and Risk

Shipping charges, if any, are shown at checkout before you pay. Where tracking is available, we will provide tracking information by email. Risk of loss and title for physical goods pass to you on delivery to the address provided. Please provide a complete, accurate shipping address (including unit number and postal code). We are not responsible for delays or non-delivery caused by incorrect or incomplete addresses, or by the carrier or customs.

### 10.3 Hamilton/GTA Local Delivery and Local Pickup (Where Offered)

Where offered at checkout or by arrangement, Beliv Studios may offer: (a) local delivery within Hamilton/GTA, which may be personally delivered on weekends only, within a delivery window we confirm with you; and/or (b) free Local Pickup from a designated pickup location and time by appointment. Local-delivery availability, fees (if any) and boundaries are as shown at checkout or confirmed in writing. Someone aged 18 or older should be available to receive the delivery, or you must provide safe drop-off instructions at your risk.

### 10.4 Delivery Estimates and Delays

Delivery dates are estimates in good faith. Delays may occur due to production, carriers, weather, or events beyond our control. If a delay will materially affect a time-sensitive order (for example, event-date cards), contact us as soon as possible. Your remedies are as set out in Section 11 and applicable Ontario law.

### 10.5 Digital Delivery

Digital products, downloads and galleries are delivered electronically to your email address or client gallery. No shipping charge applies unless stated. It is your responsibility to ensure your email and device can receive and open the files, and to download within any stated availability period.

## 11. Returns, Refunds, Cancellations and Digital Products

Your Ontario rights: Nothing in this Section limits any cancellation or refund rights you have under Ontario's Consumer Protection Act, 2002 or other applicable law. If these Terms conflict with a mandatory consumer right, the law prevails.

### 11.1 Physical, Non-Customized Products

Damaged, defective or wrong item: If a physical, non-customized product arrives damaged, defective, or materially not as described, contact us within 14 days of delivery with photos and your order number. We will repair, replace, or refund the item price (and, where required, original shipping) after assessing the issue and, if requested, after the item is returned.

Change of mind: For change-of-mind returns of unused, non-customized physical products in original packaging, contact us within 14 days of delivery to request authorization. If accepted, return shipping is at your cost unless we state otherwise, and a refund will be issued to the original payment method after we receive and inspect the item. Items that are used, damaged by misuse, or not in resalable condition may be refused or partially refunded.

Exclusions: Seasonal, perishable, intimate, or clearly marked "Final Sale" items are not eligible for change-of-mind returns, but remain covered for defects as above.

### 11.2 Customized, Personalized and Print-on-Demand Products

Customized, personalized, or made-to-order products (including cards printed with your text, photos or verses, framed prints made to your specification, and print-on-demand items produced for you) cannot be returned for change of mind, because they cannot be resold. We will, however, replace or refund where there is a material defect in materials or workmanship, a printing error by us or our production partner, or a material deviation from the proof you approved. Please inspect digital proofs carefully before approval (see Section 9.5). Minor colour variations due to screen or print differences are not defects.

### 11.3 Digital Products and Downloads

Due to the nature of digital files, once a digital product or gallery download has been made available and accessed or downloaded, it is generally non-refundable for change of mind, except where the file is corrupt, cannot be accessed due to our error, or is materially not as described — in which case we will provide a corrected file or a refund. This does not affect statutory rights where the digital content is faulty. Do not share, resell or distribute digital files except as licensed in Section 5.

### 11.4 Photography, Videography and Livestreaming Bookings — Cancellation by You

Notify us in writing (email) as soon as possible. The booking fee or deposit referred to in Section 7.2 applies as stated in your booking agreement and as permitted by law, because the date was reserved for you. Amounts paid beyond the booking fee will be handled as set out in your booking agreement, less any non-recoverable costs already incurred (for example, venue or equipment bookings, production, travel) that we disclose to you.

Force majeure or postponement: If a government order, venue closure, or other event beyond either party's reasonable control makes the event impossible (not merely difficult), we will work with you in good faith to reschedule. If rescheduling is impossible, refunds will be handled in accordance with your booking agreement and Ontario law, less work already performed and non-recoverable costs.

### 11.5 Cancellation by Us

If Beliv Studios must cancel a confirmed booking or order due to circumstances within our control, and we cannot provide a suitable replacement or reschedule you accept, we will refund all amounts paid for the undelivered services or products promptly. This refund is your primary remedy for our cancellation, subject to Section 18 and applicable law, which may provide additional rights.

### 11.6 How to Request a Return or Refund and Timing

Contact us at info@belivstudio.com with your order or booking number, name, and reason. Refunds approved by us will be issued to the original payment method through Stripe, normally within 5 to 10 business days after approval or receipt of returned goods, depending on your bank. Shipping charges are non-refundable for change-of-mind returns. Your statutory right, where applicable, to cancel an internet agreement within the period and in the circumstances prescribed by the Consumer Protection Act, 2002 (for example, if we fail to provide required disclosure or delivery within the statutory period), is preserved. Where that right applies and you cancel as prescribed, we will refund all amounts paid as required by law.

### 11.7 Complaints

If we cannot resolve a complaint informally, you may contact Consumer Protection Ontario or seek other remedies available at law. Contact details for consumer help are available on the Government of Ontario website and are not replaced by these Terms.

## 12. Gift Cards, Promotions and Pre-Orders (If Offered)

If Beliv Studios offers gift cards, discount codes, bundles (for example, Christmas and New Year card bundles) or pre-orders, the specific terms shown at the time of offer (expiry, restrictions, delivery timing for pre-orders) apply in addition to these Terms. Discount codes cannot be combined unless stated, have no cash value, and may be withdrawn if misused. In Ontario, most retail gift cards cannot expire and fees are restricted under the Consumer Protection Act. We will comply with applicable rules if we issue gift cards. Pre-order products will only be charged as disclosed at checkout, and may be cancelled by either party as stated at the time of pre-order if production is delayed materially.

## 13. Privacy, Photographs of Individuals and Consent

### 13.1 Privacy and PIPEDA

We collect, use and disclose personal information in accordance with our Privacy Policy (available on the Website) and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario law. Information collected for orders, bookings, galleries and enquiries (for example, names, contact details, event details, photos and videos, and payment confirmations via Stripe) is used to provide the services, process orders, deliver galleries and products, and communicate with you. We do not sell personal information. See the Privacy Policy for details on retention, safeguards, and access or correction rights.

### 13.2 Consent to Be Photographed or Filmed, and Portfolio Use

For bookings, the client confirms it has informed attendees, where appropriate, that photography, videography or livestreaming will occur, and has obtained any consents required from venues and officiants and, for minors, from parents or guardians. Beliv Studios will photograph or film the event as commissioned.

We will use images or videos from your event for our portfolio, Website, social media, demo galleries, or marketing only where we have the appropriate consent or contractual permission. If a booking agreement includes a portfolio release, its terms apply. If no release has been given, we will seek permission before featuring identifiable images from a private event publicly.

### 13.3 Withdrawing Consent — Removing an Image or Gallery

If you (or a person depicted) previously consented to a public or demo gallery but later wish to withdraw consent or request removal, contact us in writing at info@belivstudio.com, identifying the gallery or image. We will act promptly and in good faith: we will unpublish or remove the relevant gallery or image from the Website, demo gallery, and portfolio or social channels under our control within a reasonable time, normally within 5 business days of a verified request; we will disable the public or demo link and, where applicable, remove the "Client Login" or portfolio link that points to it; and we cannot recall or delete copies that third parties have already lawfully downloaded, saved, printed, or reshared while the gallery was public, or copies outside our control (for example, a guest's personal copy). For that reason, we recommend prompt notice if consent changes, and we will cooperate reasonably to request removal by known third parties.

Withdrawal of consent for marketing or portfolio use does not affect the lawfulness of use made while consent was in place, nor does it, by itself, change the client's licence to use their own delivered files, or any payment obligations for services already provided.

### 13.4 Minors

We do not knowingly exhibit images of minors in public portfolios or demo galleries without consent from a parent or legal guardian. Parents or guardians may contact us to request removal at any time under Section 13.3.

### 13.5 Your Responsibility for Content You Provide

If you provide photos, videos, music, text, logos, Bible verses or quotations, or other material for us to incorporate (for example, for cards, frames, slideshows, or livestream overlays), you confirm that you own it or have all necessary permissions, including from people depicted and copyright owners. You agree to cover Beliv Studios against claims arising from material you provide (see Section 18).

## 14. Cookies, Analytics and Canada's Anti-Spam Law (CASL)

### 14.1 Cookies and Similar Technologies

The Website and its platform and payment or analytics providers may use cookies and similar technologies that are necessary for the store and checkout to function, and, where used, for analytics or marketing. Where required, you will be presented with cookie choices. You can control cookies in your browser settings, but disabling necessary cookies may prevent checkout or gallery access. See our Privacy Policy or cookie notice for details.

### 14.2 Electronic Marketing and CASL

We will send commercial electronic messages (for example, newsletters, promotions, seasonal offers for cards or bundles) only in compliance with Canada's Anti-Spam Legislation (CASL): with your express or implied consent as permitted by CASL, with clear identification of Beliv Studios as the sender, our contact information, and a working unsubscribe mechanism honoured within 10 business days. Transactional messages (order confirmations, gallery delivery, booking information) are not marketing and may be sent as needed to complete your transaction. You may withdraw marketing consent at any time by using the unsubscribe link or contacting us. This does not affect service delivery communications.

### 14.3 Reviews and Social Media

If you leave a review or tag Beliv Studios on social media, you grant us permission to repost or quote the review or tag with credit, unless you tell us otherwise in writing. We will not alter reviews to mislead.

## 15. Prohibited Use of the Website and Content

You agree not to: use the Website, galleries, or services for any unlawful purpose, or in violation of any Ontario or Canadian law, including copyright, privacy, human-rights, and consumer-protection law; copy, scrape, download in bulk, or republish Website or gallery content except as expressly permitted in Section 5; attempt to gain unauthorized access to accounts, galleries, passwords, or our systems, or probe or scan for vulnerabilities, introduce malware, or disrupt the Website; impersonate Beliv Studios, a client, or another person, or submit false, misleading or infringing content, reviews, or orders; use payment methods you are not authorized to use, or engage in fraudulent transactions or chargebacks for goods or services received; or harass, threaten, discriminate against, or abuse Beliv Studios, its clients, or other users in communications or at events.

We may suspend or terminate access, cancel orders or bookings, and/or report unlawful conduct where we reasonably believe these Terms have been breached, subject to applicable law.

## 16. Third-Party Services and Links

The Website and checkout rely on third-party providers, including the website and store platform, Stripe (payment processing), and, where enabled, print-on-demand or fulfilment partners, shipping carriers, label providers, livestream platforms (for example, YouTube, Facebook, Zoom), and social-media or embedded services. These providers have their own terms and privacy policies, and your use of them may be subject to those terms. We are not responsible for third-party websites, platforms, or content linked from our Website, or for outages, policies, or acts of those providers, but we will provide reasonable assistance where a third-party issue affects your order or livestream. Links are provided for convenience and do not imply endorsement.

Where a third-party production partner prints and ships a product directly to you, that partner's production and shipping processes apply to fulfilment, while your contract for the product remains with Beliv Studios Inc. and your consumer rights against us are unaffected.

## 17. Disclaimers

- The Website, portfolios, blogs, and product descriptions are provided for general information about our services. While we strive for accuracy, we do not warrant that all content is complete, current, or error-free, and we may correct errors without notice (subject to Section 8.1 for orders).

- To the extent permitted by law, the Website and online store are provided "as is" and "as available". We do not guarantee uninterrupted, error-free, or virus-free operation of the Website, galleries, or livestream platforms, including interruptions caused by hosting, internet, or third-party providers, but we will use reasonable efforts to restore service.

- Livestreams and technology: Livestream and video quality depends on venue internet, platform, and viewing conditions beyond our control. We do not warrant a specific bitrate, resolution, or platform availability at the time of the event, subject to what is expressly promised in your booking agreement.

- Colour reproduction in prints, cards and frames may vary slightly between screens and physical products due to printing processes. Such minor variations are not defects.

Nothing in this Section excludes or limits any warranty or condition that cannot be excluded under Ontario or Canadian law, including implied conditions under the Sale of Goods Act (Ontario) or Consumer Protection Act where they apply to a consumer purchase.

## 18. Production, Albums, Files and Print Quality

This Section collects production and delivery terms that supplement Sections 5 to 11. In the event of any inconsistency with a signed booking agreement for a specific event, the signed agreement governs for that event.

### 18.1 Coverage and Cooperation

Where Beliv Studios is retained for an event, Beliv Studios will be the exclusive professional photographer or videographer unless we agree otherwise in writing. Guests may take personal photographs provided they do not interfere with our positioning, lighting, audio, or livestream setup. You agree to designate an event contact to help identify key people and moments, to ensure the wedding party and family are available and punctual when called, and to communicate venue or officiant restrictions in advance. We are not liable for missed coverage caused by lateness, non-appearance, non-cooperation, or restrictions imposed by the venue, officiant, or other vendors.

### 18.2 Turnaround Times, Proofs and Album Design

Editing and gallery delivery: Online proof galleries are normally posted within the timeframe stated in your package. We will notify you if a material delay is expected.

Format: Final files are delivered as edited high-resolution JPEGs (and, for video or livestream recordings, in the format stated in your package) via private gallery and/or download link. Unedited RAW files, camera negatives, and rejected or duplicate frames are not delivered and remain our property, unless a separate written agreement states otherwise.

Albums and books: Where an album, book, or framed collection is included or purchased, we will prepare an initial design for your review. Reasonable layout revisions included in your package will be stated there. Additional revisions, additional pages, or upgraded materials are charged at current rates. Production does not begin until you approve the design in writing and any balance for the product is paid. Client delay in approving proofs extends production timelines day-for-day.

Retouching scope: Standard editing includes colour, exposure, contrast, and cropping in our signature style. Detailed retouching (for example, complex skin work, object removal, head swaps, or background replacement) is not included unless expressly listed, and is billed at our then-current retouching rates.

### 18.3 File Storage, Backups, Gallery Expiry and Replacement Files

Gallery life: Your private gallery will remain online for the period stated in your package. If no period is stated, the default hosting period is three (3) months from first delivery. You are solely responsible for downloading your files and keeping at least two backups before the gallery expires.

Archiving: After final delivery and gallery expiry, files may be moved to offline archive or deleted. Archived retrieval, if available, may take time and may incur an archive-retrieval and re-delivery fee, quoted on request. After twelve (12) months from final delivery we give no assurance that RAW, project, or gallery files can be recovered.

Replacement copies: If physical media (for example, a USB drive) was supplied and is lost or damaged after delivery, replacement media and re-supply of the same delivered files may be purchased at current rates, provided the files remain in our archive.

After delivery: We are not liable for loss or degradation of files after you have downloaded or received them, or for storage media, devices, or cloud services you control.

### 18.4 Print Quality, Labs and Colour

We recommend ordering prints, wall art, and albums through Beliv Studios or a professional lab we recommend, using the delivered high-resolution files. We are not responsible for colour, cropping, sharpness, or paper quality from consumer or non-professional labs, kiosks, or home printers, or for files that have been resized, re-saved, filtered, or screenshotted.

Prints and products will fade or discolour over time depending on light, humidity, framing and storage. Longevity claims depend on the materials and care. Follow any care instructions provided with your product.

## 19. Limitation of Liability and Indemnity

### 19.1 Limitation of Liability

To the maximum extent permitted by Ontario and Canadian law: (a) Beliv Studios Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of the Website, galleries, services or products, even if advised of the possibility; (b) our total aggregate liability arising from an order, booking or these Terms will not exceed the total amount you paid to Beliv Studios for the specific product or service giving rise to the claim during the twelve (12) months before the claim arose; and (c) nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be limited. Your statutory consumer rights are unaffected.

### 19.2 Indemnity

You agree to indemnify and hold harmless Beliv Studios Inc. from any claims, damages, liabilities and reasonable expenses arising from: (a) content, photos, text or material you provide to us; (b) your breach of these Terms or of any person's copyright, privacy or other rights; or (c) your misuse of the Website, galleries or delivered files. This indemnity does not apply to the extent a claim arises from our own negligence or wilful misconduct.

## 20. Accessibility, Language and Consumer Rights in Ontario

We aim to make the Website and services accessible in accordance with the Accessibility for Ontarians with Disabilities Act (AODA) as it applies to our business. If you need an accessible format or communication support, contact us at info@belivstudio.com and we will work with you. These Terms are provided in English. Nothing in these Terms removes or overrides rights granted to consumers under the Consumer Protection Act, 2002 (Ontario), the Sale of Goods Act (Ontario), or other applicable legislation. If any part of these Terms is found unenforceable, the remaining parts continue in full effect (see Section 23).

## 21. Changes to These Terms

We may revise these Terms from time to time. The revised version will be posted on this page with an updated "Last updated" date, and will apply to orders and bookings placed after that date. Changes will not apply retroactively to orders or signed bookings already accepted, except as required by law. For material changes affecting an active booking, we will notify the client by email where reasonably practicable. Your continued use of the Website after a change is posted constitutes acceptance of the revised Terms for new transactions.

## 22. Governing Law and Dispute Resolution — Ontario

These Terms, and any contract formed through the Website or for services, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. The parties will first try to resolve any dispute in good faith by discussion. If a dispute cannot be resolved informally, it will be subject to the exclusive jurisdiction of the courts of Ontario, Canada, unless applicable consumer-protection law gives you the right to proceed elsewhere. Nothing in this Section prevents either party from seeking urgent interim relief, or prevents a consumer from contacting Consumer Protection Ontario or exercising statutory rights.

## 23. General Provisions

Entire agreement: These Terms, together with our Privacy Policy and any signed booking or project agreement and order confirmation applicable to you, form the entire agreement for the subject matter they cover.

Severability: If any provision is held invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions continue in full effect.

Waiver: A failure or delay in enforcing any provision is not a waiver of that provision or of the right to enforce it later.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign in connection with a reorganization or sale of the business, with notice where required by law.

Notices: Notices to you will be sent to the email or address you provided. Notices to Beliv Studios Inc. must be sent in writing to info@belivstudio.com or to the address in Section 24.

Headings: Headings are for convenience only and do not affect interpretation.
